Representations by / on behalf of the Petitioners

Representations for implementation of Plan entitlements have been made since 2000/2001, including by the following due processes, summarising earlier representations, etc:

  • In response to Public Notice of 15.09.02 for change of land use for Sultangarhi scheme. MPISG convenors of citizens’ groups in villages and old bastis filed objections on grounds of unplanned scheme jeopardising Plan entitlements of old settlements. About 1700 families in old settlements also filed individual objections. Attention of authorities other than DDA was also drawn.
  • In WP 6980/2002 infringement of livelihood / facility entitlements by unplanned up-market commercial development are raised by MPISG and representatives of constituents, including old settlements.
  • In response to Standing Parliamentary Committee’s Notice of 22.06.03 for views on functioning of DDA, representations about non-implementation of Plan entitlements have been made by MPISG constituents and, in most cases, hearing by the committee has also been sought.
  • In response to DDA inviting comments on Master Plan 2021 ‘guidelines’ issued by MoUD on 27.07.03, MPISG Planner has filed detailed response with reference to all the foregoing and other engagements.

Requests for implementation of Plan entitlements were made after Public Notice with reference to reports of ‘alternatives’:

  • in respect of old bastis vide letter of 14.11.02 to Urban Development Minister (with copy to MoUD Secretary and DDA VC) from Rangpuri Samudayik Vikas Samiti, w.r.t announcement of builder flats for informal areas’ residents.
  • in respect of villages vide letter of 10.04.03 to DDA VC from Mahipalpur Gram Sewa Samiti with reference to news reports about ‘committee’ set up by MoUD to solve problems of villages.

About water bodies, intervention for which has been sought since 1997 and, since 2001-2002 in face of hit-or-miss “bhagidari” interventions unmindful of the complex hydro-geo-morphology of the area, following letters were later written:

  • 29.01.03: To DDA from MPISG, in report of Public Notice Hearing on 27.01.03, seeking clarification about claimed ‘permission’ to discharge sewage into Mahipalpur Hauz and plans to solve the problem in Vasant Kunj Phase 2.
  • April 2003: To GoNCTD CM from Mahipalpur Samiti, in continuation of letter of October 2002 for inclusion in plans for village water bodies, for inclusion in “bhagidari” scheme.
  • May 2003: To DDA VC (with copy to MCD Commissioner) from Mahipalpur Samiti with reference to news reports of 14 & 15.05.03 about a list of 508 water bodies placed in court to seek clarification of status of water bodies in the area
  • 15.07.03: To DDA VC (with copy to MoUD Secretary, GoNCTD CMO, MCD Commissioner, CGWA Member Secretary, ASI, DUAC, NCRPB) from MPISG Planner following breach of Mahipalpur Bundh, w.r.t press release about heritage wall in Sultangarhi and similarities with Taj Corridor scam in terms of court ordered inquiry, CBI, etc.
  • 22.07.03: MPISG Planner to Civil Aviation Minister with reference to IHC seminar on plans for Safdarjang Airport site about natural drainage disrupting schemes in context of flooding risk near IGI Airport due to Mahipalpur Bund breach. (A reply vide letter dated 28.07.03 No. MOS-I/C (CA)/2003 / DO No. Gen. 975 said “We are having the matter looked into”. Subsequent letters of 14.10.03, 20.10.03 and 06.11.03 were not replied to).

About new development in disregard of the Plan, following representations have been made:

SPORTS COMPLEX / GoNCTD INSTITUTE SOUTH OF D2

  • 08.10.02: To GoNCTD CM from MPISG Planner, w.r.t. news reports about approval to Liver Institute in Vasant Kunj.
  • 05.12.02: To GoNCTD CM from MPISG Planner, w.r.t. report with CM’s remarks about DDA violations in Vasant Kunj.
  • 28.02.03: To MoUD Secretary (with copy to DDA VC and Secretary CGWA) from MPISG Planner w.r.t. Tender for sports equipment for DDA sports complex.
  • 27.05.03: To DDA VC from MPISG Planner w.r.t. Tender for wells for Sports Complex
  • 23.07.03: To DDA VC w.r.t news report about DDA sports complex and board for GoNCTD hospital being changed to one for Institute of Liver and Biliary Science.
  • 23.07.03: To CM from MPISG Planner, w.r.t. board for Liver Institute and CM’s public remark about Plan and planners.
  • 31.08.03: To DDA VC (with copy to MoUD Secretary and CGWA Member Secretary) from MPISG Planner w.r.t. news report of foundation-stone plans for Liver Institute.
  • 07.09.03: To DDA VC (with copy to MoUD Secretary) w.r.t. GoNCTD land acquisition notice for Mehrauli ridge and news report about DDA sports complex and foundation stone laying by CM of GoNCTD Liver Institute
  • 08.09.03: To GoNCTD UDM from MPISG Planner, w.r.t Mehrauli notice and news reports of GoNCTD ‘reconsidering’ institutional land allotment in 291 cases to ask for details of basis for recommendation for Liver Institute.
  • 28.09.03: To GoNCTD UDM from MPISG Planner, w.r.t. news report about A/C mandi to again seek clarification about basis of projects in J-zone.

A/C MANDI AT ANDHERIA MORH

  • March 2003: Application to GoNCTD DC from residents of Andheria Morh for information about proposed ‘projects’ under Right to Information. The application was not accepted at the receiving counter on the plea that it could not be submitted without the DC personally checking it. Repeated attempts to contact the DC for the same failed.
  • 26.05.03: To GoNCTD DC from the Residents’ Welfare Association (Letter No. PSS/2000/03/05/204) about perceived threats from illegal actions of the government.
  • 28.05.03: To DDA VC (with copy to Secretary MoUD) on behalf of residents, w.r.t signboards saying "Greenland Maintained by APMC" put up, letter no.206/203 to seek clarification of details / approvals of Plans for the area
  • 12.06.03: To DDA VC (with copy to Secretary MoUD) on behalf of residents, w.r.t a newspaper report "Air-Conditioned Mandi coming up at Andheria Modh" and Tender of 07.06.03, letter no.PSS/2000/03/06/207 for clarification of plans / approvals. (Routine replies were received vide letters of 27.06.03 and 30.07.03 stating that the representations had been forwarded to the concerned Department and the matter was being looked into).
  • 07.07.03: To GoNCTD DC from the Residents’ Welfare Association, reminder letter pursuant to no response to the letter of 26.05.03.
  • 06.10.03: To DDA VC (with copy to Secretary MoUD) reminder w.r.t further reports about Mandi, etc. NB: APMC is learned to have deposited money for the site and has put up already a porta-cabin on it.

VASANT KUNJ PHASE 2 / SHOPPING MALL

  • July 2003: To DDA VC (with copy to Secretary MoUD) on behalf of residents of Kusumpur Pahari, w.r.t news reports of plans for Malls, to ask for a-priori residential and local commercial development to implement Plan entitlements of the old settlement in the area / site.
  • 10.09.03: To MoUD Secretary (with copy to DDA VC) from MPISG Planner w.r.t report of 04.09.03 about DDA having to cut prices, with request to reply in WP 6980/2002 (about unsustainable up-market commercial development) in view of continuing tenders / schemes – including Mall.
  • 20.10.03: To MoUD Secretary (with copy to DDA VC, CGWA, DJB) from MPISG Planner w.r.t news reports of imminent Tender for Mall, referring to WP 6980/2002, WP 4978/2002, CGWA reservations, DJB constraints, and representations from Mahipalpur, Rangpuri Pahari and Kusumpur Pahari and assurance (in WP 6980/2002) for informal sector traders, with request to stop tender.
  • 20.10.03: To Civil Aviation Minister from MPISG Planner, in context of Mall proposal for Safdarjang Airport site, about possible implications of Mall for IGI Airport.
  • 27.10.03: To MoUD Secretary from MPISG, with reference to Vigilance inquiry finding tendering irregularities in Sultangarhi, to ask about s.11A process also for Malls, as objections in Sultangarhi Public notice apply also to it.
  • 15.11.03: To DDA VC (with copy to Civil Aviation Secretary and CGWA Member Secretary) with ‘suggestion’ for Safdarjang Airport site, including shifting up-market schemes from CGWA notified areas, such as Mall.

SULTANGARHI SCHEME

  • 10.01.03: To DDA VC (with copy to MoUD Secretary) from MPISG for clarification of media remark by DDA Chairman that (contrary to Court orders) no inquiry is needed, etc
  • 29.01.03: To DDA Engineer Member (chairing Public Notice Hearing of 27.01.03) from MPISG – report of Hearing.
  • 27.04.03: To DDA Engineering Member (with copy to DDA CVO and CBI) from MPISG about removal of excavated material from site, to ask for outcome of inquiry / Hearing.
  • 02.05.03: To DDA Engineering Member (with copy to DDA VC and MoUD Secretary) from MPISG w.r.t. reports of plans for ‘studio complexes for young artists’ and building of wall.
  • 27.05.03: To DDA VC (with copy to MoUD Secretary, CGWA Member Secy) from MPISG Planner w.r.t Tender for wells.
  • 06.06.03: To DDA VC from MPISG with request for meeting in view of press release based reports about the scheme.
  • 24.06.03: To DDA VC (with copy to CGWA Member Secretary, GoNCTD CMO, MCD Commissioner, ASI, DUAC, NCRPB) from MPISG, w.r.t news report about ‘clearance’ of scheme to ask for outcome of Public Notice / inquiry.
  • 24.06.03: To MoUD Secretary from MPISG to object to ‘clearance’ of scheme.
  • 28.06.03: To PS to CM from MPISG Planner (in continuation of meeting with CM) for clarification of GoNCTD/DJB stand on ‘clearance’ and about CM’s remarks disparaging the Plan and planners (This letter was forwarded by CMO to DDA).
  • 21.10.03: To MoUD Secretary from MPISG, with reference to Vigilance inquiry finding irregularities in Sultangarhi scheme, to object to ‘clearance’ on this additional ground.

METRO

  • 03.09.03: To DMRC MD (with copy to DDA VC, MoUD Secretary and CGWA Member Secretary) from MPISG - Rangpuri Pahari for public presentation about detailed plans, especially siting of Depot in CGWA notified area and impact of alignment on existing settlements, school, etc.

RELATED GENERAL

  • 20.05.03: To Urban Development Minister from MPISG Planner, w.r.t media announcement of freehold policy, to point out need for s.11A process in view of leasehold tenure being part of the Plan.
  • 31.08.03: To DDA VC (with copy to MoUD Secretary and CGWA Member Secretary) from MPISG Planner with reference to news report about DDA submitting to Court in matter of Sainik Farms that action awaited J-Zone Plan, to point out that by same logic, ‘schemes’ should also wait.
  • 28.10.03: To MoUD Secretary (with copy to DDA VC, MCD Commissioner, GoNCTD UDM) from MPISG Planner about status of recent Public Notices, including Sultangarhi and Metro property development, and clarification of basis of Plan modifications for projects / proposals like DDA Sports complex, GoNCTD Liver Institute, A/C Mandi, VK Phase-2 Malls, freehold scheme, Safdarjang Airport plans, etc, without Public Notice.

In 2002 MPISG Planner also sent to the authorities a report on the water crisis in the area being rooted in the crisis of unplanned development. Reports on other aspects of backlog on Plan provisions were also sent in 2001.
