PIL against allotment/use of schools sites in violation of DMP / for enforcement of DMP equal access neighbourhood school system, in continuation of substantive engagements since 2000, filed in December 2003 in view of imminent orders in simplistic PIL and discourse on education Bill (allowed on 27/10/2004 with directions for rectification of violations in 12 weeks)


Prior engagements (since 2000): inclusive of illustrated report on violations with suggestions for implementing DMP equal access neighbourhood school system (June 2001), response to s.11A Public Notice of 16/09/2002, response to Standing Parliamentary Committee public notice of 22/06/2003, etc > enumerated in annexure in NCMP-DMP Note of June 2004

Violation challenged: mis-allotment / misuse of school sites in Vasant Kunj, infringing DMP equal access neighbourhood school system rights of local students and residents in all sections of the community

Core issue: Land allotment conditions help operationalize the equitable benefit purpose of land policy by which land was compulsorily acquired in Delhi for development according Plan. Accordingly, conditions about type of school, local enrolment and free seats help operationalize Master Plan provisions for equal access neighbourhood schooling, which cannot be compromised, irrespective of the price charged for allotment. Use of school sites in violation of approved layout plan and Master Plan standards for space for buildings, parking, etc, leads to up-market schools in excess of what local demand can sustain. Schools tap city-wide market in violation, at cost of residential amenity, of local enrolment provisions. In the resultant exclusion due to commercialization, the poor among local students are worst affected as free seats' conditions are flouted with even greater impunity. This, in turn, makes for violations in government schools, burdened with enrolment in excess of and space short of standards and resultant environment not at all conducive to quality learning. Inequity in education cannot be removed by charity in residual resource space. It requires equitable access to resources, primarily space, for schooling - more so when inequitable use of school sites is illegal.

27/10/2004: Seventh listing: Petitions allowed: "It is true that in the matter it is pointed out by the learned counsel for the petitioner that in fact some parcels of land indicated in the lay-out plans as for the use as Nursery Schools are being used as integrated schools. On behalf of the Education Department, it is stated that only those schools which meet with the norms have been granted permission for upgradation. The learned counsel for Delhi Development Authority (for short "DDA") submitted that no permission has been obtained from the DDA. It is clear that when a layout plan has been prepared, any variation thereon must be according to the law. If any change is required to be made in such a plan, then only DDA can take appropriate action. In such a situation, it is for the Education Department to move the DDA for making necessary changes in the layout plan. So far as the other violators are concerned, it is pointed out on behalf of the DDA that show cause notices have been issued to the persons who have violated the conditions and it is assured that action will be taken against such violators in accordance with law after considering their replies. Let the action be taken within a period of 12 weeks. With this direction the petition is disposed off."

W.P.(C) 3156/2002: Vice Chairman, DDA, Director of Education, and Land and Development Officer are present. Ms. Ahlawat, learned counsel for Director of Education has submitted an affidavit accompanied by three charts showing the position of compliance or default by various unaided but recognised schools to whom land was allotted by DDA and LandDO at concessional rates. A copy of this affidavit and the attached charts be supplied to all concerned parties through their counsel who are required to obtain these copies from the chamber of Ms.Ahlawat. Ms.Ahlawat is also required to submit a list of defaulters who have not complied with the stipulation of the lease deeds or allotment letters, with a copy to Mr.Rakesh Khanna, advocate or any other counsel representing these defaulters who are requiredto file their reply within one week.   • eebill mailing list: The Constitution of India, committed to universalisation of education through a directive principle, was amended to make free and compulsory school education a right. The amendment requires a law to be enacted, draft Bill for which was prepared and twice modified in 2003. In the discourse about the draft bill as well as in recent PIL on free seats for the poor concern for a common school system has been amply reiterated. But holistic solutions suggested in existing law, such as in the equal access neighbourhood school provisions of Delhi Master Plan, although being sought by communities, continue to be disregarded in the discourse. This list is for discussion premised on already existing law, so that the proposed education law improves upon them.
  • NCMP-DMP minder (facilities section; suspended): DMP gives legal strength to commitment to equal access neighbourhood schools that draft education Bill 2003 and compliance of court order in PIL for free seats have been diluting. PIL on free beds in hospitals, likewise, is confusing equity basis of DMP for charity perspective. NCMP commitments called for progressive implementation of DMP schema for social facilities (also as framework for optimally absorbing resources committed without central law for education). nstead, statutory DMP provisions for equal and efficient access for all to healthcare and education have been all but dismantled. Illegal allotments and use of facility sites stand condoned by continuing disregard of efforts since 2000, including PIL of 2003, against them. DMP's holistic concept of equal access stands reduced to beggarly prayer for freebies for the poorest, with definition of both opened to negotiations, as a result of simplistic PIL. The decks stand cleared for those with their hearts set on providing noble services in global markets - and decisions to reduce or do away with conditions, even sites, needed to ensure access for citizens are unlawfully but freely being taken.
